EOR-Core (GEMM-01)

GemmWork Definition
The lowest-risk GEMM mode: full-time strategic employment via Employer of Record. PE Risk: 🟢 Low. GemmWork's default recommendation for most international hiring scenarios.

EOR-Core (GEMM-01) is the first and most protective mode in the GEMM Framework. It describes a full-time, indefinite employment relationship mediated by an Employer of Record.

GEMM-01 Scorecard Profile

Variable Score What it means
PE Risk 🟢 Low EOR is the legal employer; US company has no local presence
Misclassification Risk 🟢 Low Proper employment relationship eliminates reclassification exposure
Compliance Stickiness 🟡 Medium Exit requires statutory severance; structured but manageable
Cost Efficiency ★★★★☆ EOR fee (~$599/mo) offsets some of the salary arbitrage
Legal Employer EOR provider Not the US company
GemmWork Verdict ✅ Recommended Default mode for new-country market entry

When EOR-Core Is the Right Choice

  • Entering a new country for the first time — EOR eliminates the need to register a local entity
  • Headcount below 15–25 in the same country — below the EOR breakeven point, entity setup costs more
  • PE risk is a top concern — EOR provides the strongest structural protection
  • Strategic, indefinite role — core team members who will own systems long-term

When to Consider Moving Away from EOR-Core

  • Headcount exceeds 20–25 in the same country → entity setup becomes cheaper
  • Equity grants are needed for engineers → direct employment via local entity is cleaner
  • Permanent Establishment is already established → EOR is no longer the right structure

All-In Cost Example (Colombia, Senior SWE)

Component Monthly cost
Gross salary ($42,000/yr) $3,500
Employer payroll tax (21.5%) $752
EOR fee (Deel) $599
Total all-in $4,851/mo

vs. US equivalent: ~$13,000–$16,000/mo all-in

In the GEMM Framework

EOR-Core is GemmWork's default recommendation. It appears in the recommended column of every country scorecard where PE risk is a concern.
